ESAM is hosting a virtual Lunch and Learn webinar on June 24th, 2024 on the proposed New Brunswick Contaminated Sites Regulation which has recently been posted for public review and comment by June 28th, 2024 (more info below). NBDELG will present an overview of the proposed Contaminated Sites Regulation. Following the presentation there will be an opportunity for questions and discussion.
Overview
The New Brunswick Department of Environment and Local Government (DELG) has posted the draft Contaminated Sites Regulation and the associated draft Administrative Penalties regulation, both under the Clean Environment Act, for public review and comment.
The proposed Contaminated Sites Regulation establishes clear requirements for the assessment and remediation of contaminated sites and includes regulated timelines for the work to be completed. The DELG is also proposing an associated Administrative Penalties Regulation in an effort to promote compliance with the new Contaminated Sites regulation. The proposed Contaminated Sites Regulation is a key deliverable for the DELG to address two recommendations in the 2022 Performance Audit Report of the Auditor General. If approved, the Contaminated Sites and Administrative Penalties Regulation would come into effect on August 1st, 2024 and would apply to new contaminated site files that are opened on or after that date.
Consistent with Government’s policy on regulatory transparency, stakeholders are being advised of these proposed new regulations. The Contaminated Sites and Administrative Penalties Regulations can be found online on the Public Review of Draft Regulations Website.
